The U.S. Department of Labor (DOL) announced that its proposed overtime rule is now tentatively slated to be released in October.
This proposed rule will recommend to employers how to implement the exemption of bona fide executive, administrative and professional employees from the Fair Labor Standards Act's (FLSA's) minimum wage and overtime requirements.
Part of this rule will encompass potentially raising the annualized salary level from its' current $35,568. While many are pushing for this salary level to be increased anywhere from $62,000-$80,000, it will likely increase to around $47,476.
The proposed overtime rule will state the processes for exemption of executive, administrative and professional employees.
An employee's exempt status is determined by the employee's primary duties and whether those duties are exempt
